These Terms and Conditions ("Terms") govern all sales, services, and interactions between you ("Customer") and Marquise Mountain Manufacturing, LLC ("Marquise Mountain," "we," "us," or "our"). By placing an order, accepting a quote, or engaging with our services, you agree to be bound by these Terms. These Terms will supersede any terms and/or conditions that are stated or implied by a person or company, regardless of whether Marquise Mountain or an authorized member signs them or not.  

2. Product Information

Marquise Mountain specializes in the design and manufacture of high-quality CNC machine and fabricated components. We strive for accuracy in product descriptions, specifications, and pricing. However, we reserve the right to correct any errors or omissions and to update product information at any time without prior notice.

  • Custom Products: All custom CNC and fabricated components will have an overall tolerance of +-0.005" for metal and +-0.010" for plastic, unless explicitly stated in the form of a drawing.

3. Ordering Process

  • Order Placement: Orders can be placed through our website, via email, or by phone. All orders are subject to acceptance by Marquise Mountain.
  • Order Confirmation: Upon acceptance, we will provide an order confirmation detailing the products, pricing, and estimated lead times.
  • Custom Orders: For custom or made-to-order products, specific terms regarding design approval, lead times, and pricing will be communicated separately.
  • Marquise Mountain Manufacturing reserves the right to refuse service or sale of product at any time for any reason.

4. Pricing and Payment

  • Pricing: All prices are listed in U.S. dollars and are subject to change without notice. Prices do not include taxes, shipping, or handling fees unless explicitly stated.
  • Payment Terms: Payment is due as specified in the invoice. We accept cash, check, credit cards, and ACH transfers. For approved accounts, Net 30 terms may be available.
    • We will charge a $35 fee on all returned checks. 
  • Late Payments: Invoices not paid by the due date may incur a late fee of 2% per month plus any fees incurred in collection of payment.

5. Shipping and Delivery

  • Shipping Methods: We utilize reputable carriers to deliver products. Shipping costs are calculated based on weight, dimensions, and destination.
  • Lead Times: Estimated lead times are provided at the time of order confirmation. While we strive to meet these estimates, actual delivery dates may vary due to unforeseen circumstances.
  • Risk of Loss: Title and risk of loss transfer to the Customer upon delivery to the carrier.

6. Returns and Exchanges 

  • Custom Products: Custom or made-to-order products are non-returnable and non-refundable unless defective.

7. Warranty

Marquise Mountain warrants that its products will be free from dimensional or workmanship defects at the time of shipment. This warranty does not cover damage caused by misuse, improper installation, or unauthorized modifications. Our liability under this warranty is limited to repair, replacement, or refund of the defective product, at our discretion.

8. Limitation of Liability

To the maximum extent permitted by law, Marquise Mountain shall not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use our products or services. Our total liability shall not exceed the purchase price of the product in question.

9. Intellectual Property: Copyright and Trademark

  • Copyright: All content on our website—including but not limited to product designs, CAD files, manuals, logos, images, graphics, documentation, and written material—is the exclusive property of Marquise Mountain Manufacturing, LLC and protected by U.S. and international copyright laws.
    • You may not copy, distribute, modify, or use our content for commercial purposes without our prior written consent.
    • Any downloadable files or resources provided are for personal or business use only and may not be redistributed or sold.

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts located in Pinellas County, Florida.

Marquise Mountain reserves the right to amend these Terms at any time. Updated Terms will be posted on our website, and continued engagement with our products or services constitutes acceptance of the revised Terms.
